美国考虑加强对留学生限制 中国外交部回应

在中国19日的外交部例行记者会上，有记者问：美国务院称美方正考虑加强对外国留学生的限制，如限制研究成果发表丶增设研究禁区等，以保护美科研创新成果不被外国剽窃。你对此有何评论？是否认为此举将损害中方利益？

外交部发言人洪磊回答说：我要强调的是，第一，哪里有发明，哪里就有知识产权保护，这是时代的潮流。中国政府和中国年轻一代对此很适应，我们也一直提倡和推进知识产权保护。第二，中国的科技发展是中国人民自力更生丶艰苦奋斗丶锐意拼搏，用智慧和汗水铸就的，外界不要贪天之功。

近年来针对亚裔经济间谍或者盗窃商业机密案件，美国联邦检察官发起了很多备受瞩目的诉讼。联邦调查局也曾在其官网发表题为《高等教育与国家安全：目标对准高等学府校园中的敏感丶专有和机密信息（Higher Education and National Security: The Targeting of Sensitive, Proprietary, and Classified Information on Campuses of Higher Education）》的文章并警告称，研究人员和学术界的创新与合作是帮助美国研究成功的基石，但这些特质使美国大学成为外国政府和公司的目标。据2015年联邦调查局反情报部门的一份未公开报告称:“外国的对手和经济竞争企业会利用在大多数教育机构的开放和合作氛围开展间谍活动，以获取经济机密…或先进技术。”

然而这些针对中国学者的诉讼中很多尽管一开始看起来声势浩大，但是最后都被证明是无稽之谈。

主流英文媒体CBS新闻和“60分钟” (“60 Minutes”)栏目5月15日播放一集专题报道“集体损毁”(Collateral Damage)，聚焦华裔科学家被错误指控为经济间谍的冤假错案。纽约华人非盈利组织百人会（Committee of 100)对此表示赞赏，认为新闻媒体的报道能引起人们对无辜华裔科学家遭不公正起诉的关注。

百人会16日发表声明称，报道中讲述的郗小星和陈霞芬案件只是最近两起华裔科学家被司法部错误指控的例子而已，司法部后来撤销诉讼，但却没有任何解释，也没有道歉，然而两位科学家的个人和事业都已经遭到毁灭性的的后果。百人会会长吴华扬指出，基于种族丶族裔丶祖籍国针对部分人进行错误指控的模式，违背了这个国家的本质。他说：“政府丶社区机构丶个人和媒体携手合作是非常重要的，这样才能确保我们秉承无罪设定丶正当司法程序和所有人得到平等保护的美国理想。”

百人会自从2012年起为亚裔科学家举办了一系列教育讲座，介绍美国对贸易机密丶戒牒和出口管制的相关法律和风险。“60分钟”专题报道中也提到了百人会。

除“60分钟”外，主流英文媒体《洛杉矶时报》(Los Angeles Times)也曾于5月4日发表文章称，虽然其他国家盗取商业机密的情况的确有发生，但是政府却过多的将目标放在中国身上。自1997年来涉及到其他国家的55起盗窃商业机密以及经济间谍案中，美国将其中70%的目标都指向了中国。但是，政府最后却没能给这些案件带来一个令人满意的结果，这足以说明其中肯定存在误区。

从1997至2015年，在所有刑事案件诉讼中，联邦检察官最后获胜的比例高达91%。但是自1997年来，涉及到中国的经济间谍案件中，联邦检察官的胜率仅有66.7%。与之相反的是，涉及到其他国家的类似案件的时候，检察官的胜率却有87%。

出于防止中国间谍活动的压力，看起来在很多案件中，检察官甚至没有掌握足够的事实就会提起诉讼。

2009年在圣何塞（San Jose），第一起类似的经济间谍案中，检察官指控两名华裔工程师是为中国政府服务，原因仅仅是因为他们接受了来自中国的资金支持。陪审团最终否决了检察官的这一指控，表示这只是一次寻常的商业活动。

去年5月，前天普大学（Temple University）教授郗小星被联邦调查局特工逮捕，被指控分享某些后来被证明非机密的“秘密”。几个月后，检察官撤诉，整件事情成了一场闹剧。

对很多观察家来说，政府对亚裔的不正当怀疑始于1999年，当时任职于洛斯阿拉莫斯国家实验室（Los Alamos National Laboratory）的华裔核物理学家李文和，被指控向中国泄露核机密。当时她被指控的原因很可笑，仅仅是因为她能够接触到机密，而又频繁前往亚洲。最终这一案件被撤销，七年后，李文和也在民事诉讼中击败对她声誉造成不良影响的检察官和媒体。

而李文和的代表孙律师指出：“一个多世纪以来，华人在美国所受到的种族主义不公待遇丶误解和偏见从未停止过。”

他还进一步谈到：“在美国生活的华人数量迅速增长，然而历史的悲剧却在重复上演，且‘不测’有可能发生在我们每个人身上。据2010年美国人口调查，大约有400万华人在美国生活。从2011年起，进入美国高校的中国学生数量每年都以20%以上的速度增长，现近40%的成年美籍华人拥有学士以上学位，中国学生目前占美国所有工科学生的20%。”

孙律师还提出了一些避免“惹祸上身”建议：“首先，要了解所有适用的美国法律，且一定要了解并意识到，所有被送往或带到中国的物品（包括邮件丶短信和传真）都可能作为联邦调查的潜在证据，更要谨防被设圈套，一旦发现自己有被调查的情况要立即聘请专业律师。”
