　　社会福利占不得，白卡不白拿，迟早要追讨回来。7月27日，纽约市社会服务部(Department of Social Services, DSS)递交了一份起诉书，状告纽约史坦顿岛一名易姓（Yee）妇女，要求她偿还政府为她丈夫支付的医疗援助帐单，金额高达23万4千多美元,这笔钱必须连本带利，全部付清。

据起诉书，华裔妇女的丈夫易先生于2016年4月获准入住一家颇有名气的犹太护理养老院，之后易先生委托代理人，向纽约市社会服务部申请低收入医疗补助计画（Medicaid，俗称白卡）。

白卡福利是州政府给低收入人群的医疗服务资助，而非无偿救济。易先生在申请白卡的时候，没有提供他妻子易太太的收入和资产信息，没有如实申报，隐瞒了资产。

最终，易先生的白卡获得批准，从2016年5月1日至2018年7月1日，SSL为易先生支付每日养老院的费用，合计26个月用掉234,569.65美元，平均每个月花费9,000多美元。

社会服务部DDS最近发现，易先生在获得白卡时，易太太实际一直拥有376,690.55美元的资产，完全有能力支付易先生的23万美金的医疗费。

最终，社会服务部DDS将易太太告上曼哈顿民事法庭，指她违反"隐含合同"，要求连本带息收回之前政府代付的医疗支出，并追讨白卡提供的任何用品或服务费用。








配偶有能力支付不可申请福利
根据纽约州社会服务法（SSL）第101条(1) ，366(3)(c) 丶366(3)(a) 和104(1) 等，公共援助或照顾接受者的配偶，如果有足够的能力，应负责照顾，而无需公共援助。

如果有赡养义务的亲属（responsible relative）拒绝或未能提供收入和资产信息，则政府提供此类医疗援助的同时，追讨权会根据法律而隐含于合同内（implied contract，隐含合同），政府可根据第三条第六项和其它适用的法律规定，从该亲属处收回（政府代付的费用）。

隐含合同一般指某种非正式协议，合同当事人虽没有口头或书面表示，但已有行为或有关文件表示履约丶具法律效力的合同。合同之"默示"，有诚实信用原则或公共利益出发的含义。
