在美国被炒了？H1B失效了？别慌张

如果在美国你持H1-B签证工作，突然有一天，老板通知你去他办公室告诉你“你被解雇了！”并让你立即卷铺盖走人（注意：在美国被解雇是很常见的事，尤其是遇到很差劲的老板的博士后研究人员，随时可能面临卷铺盖走人的压力。在工业界也一样，尤其是小公司，工作一般缺乏稳定性），遇到这种情况怎么办？由于 H1-B没有grace period，这意味着从老板解雇你的那一时刻起，你在美国立即失去了合法身份，按理你必须立即离开美国。否则，你在美国的身份就“黑”下来了。凡在美国曾经“黑”过的外国人，今后是不能申请绿卡的（跟美国公民结婚例外），另外几年后，要再来美国也会被拒签。因此，怎样才能在被解雇的困难时刻，转危为安而又合法在美国停留呢？

是不是H1-B被解雇就没有办法了呢？不是，办法还是有的，要不然那么多去了美国的中国人，怎么没几个回来的。

这里，艾克想对H1-B突然被解雇时的应对策略做一个总结，希望对已经在美国的朋友或者即将来美国的朋友有所帮助。

虽然从法律角度说，H1-B被解雇后立刻失去合法身份，但美国移民局（USCIS）在实际操作上会有些出入。实际操作时，一般允许有7天（一个星期）的缓冲，只要你在这7天内递出身份转换申请，并收到receipt，就可以在美国继续合法待下来。

7天显然太紧张了，因此有人想方设法要延长这个时间，可不可能呢？答案是：可能！一般公司解雇一个H1-B职员后，有两个日期是很重要的，一个是停发工资的日期（即last pay check day），另一个是公司上报美国移民局（USCIS）中止该H1-B资格的日期(termination date)。H1-B真正失效的日期实际上是后者，即termination date，所以虽然你被解雇了，但只要美国移民局不知道这件事，你就没事。所以有些人被解雇后，为了获得更多的缓冲时间，就去找工资HR（主管人事的部门）商量，请求将上报移民局的时间延后一些。有些公司的HR比较nice，就同意了，这样这个H1-B被解雇的人就能获得更多的缓冲时间和转身份时间。

1）H1-B被解雇后，要获得合法身份继续在美国待着，最好的选择是，立即广撒网联系丶投递简历，开始找下一家公司，并让他们立即为你递交H1-B Transfer申请，但必须确保你能在termination day之前收到USCIS的receipt。但这种方式比较难，原因是很难在很短的时间内找到下一家愿意接收你的公司。

2）如果你结婚了，那么恭喜你！你留在美国的机会大多了！！例如，如果你配偶持F1，H1-B等身份，你可以立即向USCIS递交F2, H4等申请，即转换为配偶身份。只要确保你能在termination day之前收到USCIS的receipt，你就能在美国继续合法地待下来。在美国，很多人采用这种方式先留在美国，然后再慢慢找工作。一旦找到新的工作，立即再次递交身份转换申请，从F2或者H4转回H1-B身份。所以，在美国混，最好夫妻两人都有合法的工作或学习身份，比如丈夫是H1-B，妻子是 F1(当然妻子如果也是H1-B更好)，这样当丈夫失业后，可以立即跟随妻子转为F2；妻子如果丢了学生身份，可以立即跟随丈夫转为H4身份。这样可互为犄角之势，立于不败之地矣！所以在美国没有结婚的，赶紧结婚吧，呵呵。

3）如果没有结婚，单身一个，就比较麻烦一点了。此时可以立即联系学校，看能否将身份暂时转换为F1。注意：这里所说的学校，并不一定要是大学，很多社区学院都是可以的。很多大城市（例如纽约等）附近，有很多社区语言培训学院(Community Language School)。H1-B被解雇后，可以考虑申请这类语言学院，只要新的I-20到手，就可以以F1身份在美国继续合法待下来了。不过近年来，USCIS对这类申请卡得越来越严了。但紧急时刻，哪怕有一丝希望，也得争取啊！当然了艾克可以帮您处理好所有的事情助您尽快恢复身份。

4）还有一个办法，就是立即跟持F1丶H1-B丶J1等身份的人结婚。结婚后，立即递交F2丶H4丶J2等配偶身份申请。但临到跟前儿才想找个人结婚，哪那么容易啊？除非假结婚，呵呵。

5) 立即跟持美国护照（即美国公民）的人结婚，然后同时递交I-130和I-485婚姻绿卡申请。虽然绿卡不一定马上下得来，但只要收到I-485 receipt，就能合法在美国停留下来（绿卡等待期间，可以在美国合法居住，绿卡等待身份可以称为I-485 pending，也可以成为AOS: Adjust of Status）。

6）跟已经递交I-485绿卡申请丶但还没有批的人结婚，如果对方的绿卡优先日期已经current（current意味对方的绿卡排期已经到了），那么你可以作为配偶立即递交I-485申请，拿到I-485 receipt后，你就可以以I-485 pending的身份在美国合法待下来。

7）如果你自身条件足够强（比如你有学术论文发表丶当过学术期刊论文评阅人丶获得过重大国家级奖励，在国内获得的奖励也算，等等），你可以立即递交第一类职业移民申请（即EB1a），递交后，你的身份就是I-485 pending身份，从而可以合法待下来等待绿卡审批（但I-485 职业移民绿卡等待期间如果没有工作，绿卡申请可能会有麻烦，所以递交I-485的同时申请一个工卡EAD，就可以边工作丶边等绿卡了）。

8）如果上述方法都试过了，还不行。最后就只有“三十六计丶走为上策”了，那就是回国。回国后，如果还想来美国，那么回国后可以继续联系美国的公司（或学校），东山再起，重新申请H1-B签证回美国来。不过，近年来，美国经济持续下滑，美元持续贬值，竞争力已经大不如前，回国生活和工作，其实也不失一个很好的选择。

本文虽然是对持H1-B工作的朋友写的，但大部分内容也适用于持J1工作（只要已豁免，大部分策略也适用）的朋友。
